End Discrimination Against Jobless with Leadership, Not Litigation (ContributorNetwork)

COMMENTARY | Solving the problem of discrimination against the jobless is a task for a leader. President Barack Obama included a provision to outlaw such discrimination in the American Jobs Act, but by resorting to legislation, he overlooked a far more effective tool for solving the problem.

The American Jobs Act is causing bad vibes among some employers due to the provision that would open them to lawsuits for discriminating against the unemployed in hiring. Republican leaders jumped on the discrimination ban, saying it's unnecessary and targets an uncommon occurrence. Texas Rep. Louie Gohmert said the bill would create a new protected class and encourage litigation.

While anecdotal reports document the existence of jobless need not apply ads, the Equal Employment Opportunity Commission has not drawn any conclusion about the prevalence of this practice. But as far back as July, media sources were reporting on the appearance of hundreds of online help wanted ads that restricted the applicant pool to the currently employed.

New Jersey outlawed such discrimination and other states were considering following suit. While the size of the problem may not be firmly established, there does seem to be a problem of sufficient magnitude to warrant federal attention. Discrimination against jobless people seeking work will hinder the economy and lead to numerous social ills. It doesn't follow, though, that legislation is the answer.

The critiques of AJA are spot on in suggesting the proposed law could encourage a spate of litigation, much of it frivolous. Undoubtedly, employers would cease advertising "must be currently employed," making it nearly impossible to discern the reason for a particular candidate's rejection. With very large employers, the argument would be reduced to statistics instead of a more accurate assessment of individual hiring decisions.

The president missed an important opportunity when he put forth the American Jobs Act and it isn't too late for him to remedy his mistake. He should use his moral authority as the country's leader to speak out against the practice of discriminating against the unemployed. He should hire the unemployed and make it known he has done so. He should instruct federal agencies to put the unemployed and employed on equal footing when it comes to hiring.

With the power of the White House behind him, the president doesn't need a law to influence hiring practices. He can extract commitments from top corporate executives to ensure the unemployed are fully and fairly considered for job openings. He can use the visibility of his office to publicly commend companies hiring the unemployed in significant numbers.

That's what being a leader is all about.

(AP) ? Over months, Venezuelan TV soap opera writer Leonardo Padron built a Twitter following of about 250,000 people by posting more than a dozen messages a day, many of them skewering President Hugo Chavez.

On Aug. 29, Padron issued a typical shot: "Chavez knows of the immense death toll that there is in this country, so why such indifference to the subject of insecurity?"

Three days later, however, the tweets picked a new target: Padron himself. "In no way have I contributed to combat racism, discrimination, cultural alienation," one note read. "My soap operas feed these evils in our society."

Padron had fallen victim to an unknown hacker or group of hackers who have hijacked the accounts of at least nine well-known Chavez critics, posting curse-filled insults, threats and slogans such as "Long live Chavez."

One late-night post called a journalist a homosexual, and another threatened a Chavez opponent: "I'm going after you little by little, Damned Narco." Doctored photos show opponents wearing red berets of the sort favored by the socialist leader.

The burst of Twitter hacking has opened a new battlefield in Venezuela's heated political wars. Some Chavez critics say their email accounts have also been compromised.

A group calling itself "N33" has claimed responsibility for the Twitter attacks, and those targeted have had "N33" appear on their Twitter profiles.

All sorts of theories have been circulating about who is behind N33, ranging from Chavez allies to opponents trying to make the government look bad. Some wonder if it could be a single young hacker trying to make a statement.

Padron heard from an acquaintance that his account was sending out insults. He had been wondering why he wasn't able to sign in to Twitter. Suddenly, it was clear: Someone had stolen his password and shut him out.

"It's an invasion, a humiliation. It's as if you're about to go into your house and the door doesn't open with your key, and you sense there's someone inside posing as you," Padron told The Associated Press in an interview.

"You don't imagine that your 2.0 life is going to be stolen, that your voice is going to be expropriated," Padron said. "Of course, I began to have a very strong feeling of indignation."

Other victims of the attacks this month have included an activist, a humorist, three journalists, a TV show host, an ex-diplomat and a former Chavez supporter, all of them openly critical of Chavez.

Some of the victims have complained to authorities. Attorney General Luisa Ortega Diaz said that two prosecutors are collecting evidence and will talk to witnesses.

Both Twitter and Google say the attacks most likely involved phishing, a form of Internet fraud in which victims are tricked into revealing passwords or other personal information through emails with links to pages that appear to be authentic. Once a victim enters a password for Twitter or an email account on a fraudulent page, hackers are able to use it to take over the real account and change the password.

About 2 million Venezuelans, or 8 percent of the population, are Twitter users, according to figures by the local research company Tendencias Digitales. That gives Venezuela the second highest Twitter penetration in the region, after Uruguay.

Chavez's opponents regularly use the social networking site to spread critical commentary, while the government goes on Twitter to promote its policies and attack opponents. Chavez's Twitter account, chavezcandanga, reached the milestone of 2 million followers on Aug. 31.

That very day, the attacks by N33 began. In a Sept. 2 statement posted on the Internet, it called itself a group without links to "any government entity."

The statement was read aloud on state television by the host of the late night talk show La Hojilla, or "The Razor," a program that often denounces Chavez opponents.

In the statement, N33 said it had hijacked accounts to retaliate for "improper use of Twitter" and for attacking Chavez while he undergoes cancer treatment. It said Chavez's "convalescence hasn't been enough of a reason for these opposition characters ... to diminish their load of rage and bad intentions."

N33 has also taken over Gmail accounts, usually at night, stealing personal messages and photos and posting them on Twitter.

While the attacks on Twitter accounts died down after the first week of September, N33 has continued posting items extracted from email accounts on its a Twitter account, Cain_Supremo.

Activist Rocio San Miguel, whose Twitter account was taken over, also saw her personal photos and documents as well as insults and threats against her appear on the N33 Twitter feed.

"It's a feeling of powerlessness," San Miguel told the AP. "Without a doubt, they want to frighten and intimidate."

San Miguel leads an organization focused on national security and defense issues, and she likened the attacks to a sort of terrorism, saying they seem aimed at making an example of certain government critics to inhibit others.

Padron said it took him three days to block his own account. He also had to recoup email accounts that had been seized.

One of pirate posts on Padron's Twitter account sent greetings to the website "Table of Scorpions," a similarly mysterious, unsigned blog that has posted recorded phone conversations of opposition politicians.

Venezuelan law imposes prison sentences for cyber-spying or accessing others' accounts, and one 17-year-old Venezuelan was arrested four years ago for hacking into government websites. He was later released and the status of his case is unclear.

Twitter said that phishing schemes are a leading hazard.

"Most attempts to gain access to accounts target users by sending them fraudulent messages meant to trick them into sharing their passwords," Twitter spokeswoman Kristen Hawley said in an email. "A personal email account that's compromised is the second most likely way an intruder gains access to Twitter accounts."

Rafael Nunez, a Venezuelan online security expert who has experience as a hacker, noted that while N33 describes itself as a group, many of its messages are written in the first person. One such message on Twitter boasted: "I've got you going crazy."

"It's a single virtual speaker, but behind that speaker there could be collaborators," said Nunez, who heads the Venezuelan information security company Clean Perception.

Nunez was imprisoned in the United States for more than eight months in 2005 for hacking a Defense Department website and was later released. He calls himself an "ethical hacker" who saw hacking as a challenge and now uses his knowledge to improve online security.

After studying some of the latest attacks, Nunez said N33 apparently gained access to Gmail accounts by phishing for passwords or using software that enabled keystroke logging.

Nunez said he doesn't know of other countries where Twitter accounts have been similarly taken over in such a systematic way.

As for who might be behind it, Nunez said there are only theories for now.

"The language is very immature," Nunez said. "It's like a kid."

Fatalism Keeps Many From Colon Cancer Screening (HealthDay)

TUESDAY, Sept. 27 (HealthDay News) -- A fatalistic attitude contributes to low colorectal cancer screening rates among poorer people, even when the screening and cancer care are free, according to U.K. researchers.

The researchers analyzed data from a series of surveys of 529 adults, aged 60 to 69, and the study findings are slated for publication in the journal Cancer Epidemiology, Biomarkers and Prevention.

"In England, the screenings are free and the subsequent health treatments are free as well, yet people of lower socioeconomic status still do not get screened. We wanted to find out what else was going on," Anne Miles, a lecturer in psychology at the University of London, said in a journal news release.

She and her colleagues found that poorer people who felt that colorectal cancer screenings wouldn't help, or that they were going to die of cancer anyway, often ignored screening recommendations.

The surveys completed by the participants collected information about their economic status, self-rated health and rate of cancer fatalism. Researchers compared those findings to the rate of a colorectal cancer screening method called fecal occult blood testing.

Men and women with higher socioeconomic status, better self-rated health and lower cancer fatalism were 56 percent more likely to have a fecal occult blood test.

It might be possible to reduce cancer fatalism if it is properly identified in patients, Miles suggested in the news release.

"There is clearly something else going on here besides costs. We need to understand people's attitudes toward screening," she said. "If they think it won't help, they won't do it, even if it's free."

Scientists lay out plans for efficient harvesting of solar energy

ScienceDaily (Sep. 23, 2011) ? Solar power could be harvested more efficiently and transported over long distances using tiny molecular circuits, according to research inspired by new insights into natural photosynthesis.

Incorporating the latest research into how plants, algae and some bacteria use quantum mechanics to optimise energy production via photosynthesis, scientists have set out how to design molecular "circuitry" that is 10 times smaller than the thinnest electrical wire in computer processors. Published in Nature Chemistry, the report discusses how tiny molecular energy grids could capture, direct, regulate and amplify raw solar energy.

Professor Gregory Scholes, lead author from the University of Toronto said: "Solar fuel production often starts with the energy from light being absorbed by an assembly of molecules. The energy is stored fleetingly as vibrating electrons and then transferred to a suitable reactor.

"It is the same in biological systems. In photosynthesis, for example, antenna complexes composed of chlorophyll capture sunlight and direct the energy to special proteins that help make oxygen and sugars. It is like plugging those proteins (called reaction centres) into a solar power socket."

In natural systems energy from sunlight is captured by 'coloured' molecules called dyes or pigments, but is only stored for a billionth of a second. This leaves little time to route the energy from pigments to the molecular machinery that produces fuel or electricity.

The key to transferring and storing energy very quickly is to harness the collective quantum properties of antennae, which are made up of just a few tens of pigments.

Dr Alexadra Olaya-Castro, co-author of the paper from UCL's department of Physics and Astronomy said: "On a bright sunny day, more than 100 million billion red and blue "coloured" photons strike a leaf each second.

"Under these conditions plants need to be able to both use the energy that is required for growth but also to get rid of excess energy that can be harmful. Transferring energy quickly and in a regulated manner are the two key features of natural light-harvesting systems.

"By assuring that all relevant energy scales involved in the process of energy transfer are more or less similar, natural antennae manage to combine quantum and classical phenomena to guarantee efficient and regulated capture, distribution and storage of the sun's energy."

Summary of lessons from nature about concentrating and distributing solar power with nanoscopic antennae:

    Muslim students' trial nearly in hands of jury (AP)

    SANTA ANA, Calif. ? Prosecutors argue that 10 Muslim students acted as censors when they shouted down a speech by an Israeli diplomat at the University of California, Irvine, while the defense says the students acted within the law.

    The case, with defense closing arguments under way, has stoked a spirited debate about free speech not just in the courtroom but in the affluent suburban community south of Los Angeles.

    Many of the facts are not in dispute: The students carefully planned their February 2010 protest during Ambassador Michael Oren's speech about U.S.-Israel relations and were escorted out by security officials.

    Jurors will be asked to decide whether students broke the law or were exercising a right to demonstrate freely.

    The students face misdemeanor charges of conspiring to disrupt a meeting and disrupting a meeting. If convicted, they could face sentences ranging from probation with community service and fines to a year in jail.

    The case also raised questions about prosecutorial discretion, with some members of the public calling the trial a waste of taxpayers' money. Other community members have said the defendants were being singled out because they are Muslim.

    In his closing argument Monday, prosecutor Dan Wagner told jurors the students acted as censors to block the free flow of ideas and infringed on the rights of 700 people who had gone to the campus that evening to hear Oren. He said emails among members of the Muslim Student Union showed students were aware they could be arrested before the protest.

    "The right to free speech is not absolute," Wagner said before a packed courtroom of more than 180 people in Orange County, with more observers waiting outside. "If hecklers' vetoes were allowed, then nobody, nobody, none of us would have the right to free speech."

    Defense attorney Reem Salahi ? who represents two of the defendants ? said the students followed a series of protests at UC Irvine and elsewhere during which demonstrators shouted during lectures but weren't arrested or sanctioned.

    In this case, UC Irvine officials expressed their displeasure with students' actions during the demonstration but didn't give hard rules on what was or wasn't permitted, she said.

    "This is merely an admonition to be polite," she said. "But in America, we don't prosecute people for being impolite."

    Defense closing arguments were scheduled to continue Tuesday.

    In 2010, the students were initially cited, released and disciplined at UC Irvine, which revoked the Muslim Student Union's charter for a quarter and placed it on two years of probation.

    Nearly a year later, Orange County District Attorney Tony Rackauckas filed criminal charges against 11 students. The move prompted an outcry from the American Civil Liberties Union and a host of Jewish, Muslim and campus groups.

    The filing also sparked a media frenzy, and Wilson eventually issued a gag order to prevent prosecutors and defense attorneys from arguing the case outside the courtroom. The charges against one defendant were later dropped.

    Many of the students have since graduated from UC Irvine and the nearby University of California, Riverside.

    SANAA, Yemen (AP) ? Thousands of protesters backed by military defectors seized a base of the elite Republican Guards on Monday, weakening the control of Yemen's embattled president over this poor, fractured Arab nation. His forces fired on unarmed demonstrators elsewhere in the capital, killing scores, wounding hundreds and sparking international condemnation.

    The protesters, joined by soldiers from the renegade 1st Armored Division, stormed the base without firing a single shot, according to witnesses and security officials. Some carried sticks and rocks. They used sandbags to erect barricades to protect their comrades from the possibility of weapons fire from inside the base, but none came and the Republican Guards eventually fled, leaving their weapons behind.

    Although the base was not particularly large ? the Republican Guards have bigger ones in the capital and elsewhere in Yemen ? its capture buoyed the protesters' spirits and signaled what could be the start of the collapse of President Ali Abdullah Saleh's 33-year-old regime.

    "It was unbelievable," said protester Ameen Ali Saleh of storming the base on the west side of the major al-Zubairy road, which runs through the heart of Sanaa. "We acted like it was us who had the weapons, not the soldiers."

    "Now the remainder of the regime will finally crumble," said another demonstrator, Mohammed al-Wasaby. "Our will is more effective than weapons. The soldiers loyal to Saleh just ran away."

    Saleh went to Saudi Arabia for medical treatment after a June attack on his Sanaa compound and has not returned to Yemen, but has resisted calls to resign.

    A final showdown may well pit the Republican Guards, led by Saleh's son and heir apparent Ahmed, against the soldiers of the 1st Armored Division, another elite outfit that has fought in all of Yemen's wars over the past two decades, and their tribal allies in the capital.

    The Republican Guards and the Special Forces, also led by the president's son, have long been thought to be the regime's last line of defense against the seven-month-old uprising.

    The storming of the base capped two days of clashes in the capital that have left at least 50 people dead and nearly 1,000 injured, mostly demonstrators.

    Government forces used snipers stationed on rooftops, anti-aircraft guns, rocket propelled grenades and mortars against the unarmed protesters. Witnesses and security officials described scenes of mutilated bodies, some torn apart. An infant girl, a 14-year-old boy and three rebel soldiers were among the at least 23 people killed on Monday.

    "It is over," concluded protest leader Abdul-Hadi al-Azzai. "The Ali Abdullah Saleh regime is finished. How can you negotiate while massacres are ongoing? The world is silent."

    The violence led authorities to close Sanaa's airport and order four flights to go instead to the southern port city of Aden, according to an airport official, who spoke on condition of anonymity because he was not authorized to speak to the press.

    But even Aden did not escape bloodshed. Three protesters were wounded in clashes with government forces, witnesses there said.

    In the southern city of Taiz, at least four protesters were killed and 40 others were wounded Monday in clashes between anti-regime demonstrators and security forces, according to witnesses.

    The latest violence was born partly out of frustration after Saleh shattered hopes raised by the U.S. last week that he was about to relinquish power. The United States once saw Saleh as a key ally in the battle against al-Qaida, but withdrew its support for him as the protests gained strength.

    Much is at stake in Yemen for the United States, its Gulf Arab allies, particularly Saudi Arabia, and the West.

    Yemen is close to the major oil fields of the Gulf region and overlooks key shipping lanes in the Red and Arabian seas. It is home to one of the world's most dangerous al-Qaida branches, whose militants have staged or inspired a series of attacks on U.S. territory. Already, the chaos in Yemen has allowed al-Qaida militants to capture and hold a string of towns in the nearly lawless south of the country.

    Monday's events could significantly help the protesters' cause against the regime, but it is also likely to push Yemen toward civil war or to break up along tribal or regional lines.

    The clashes coincided with a flurry of diplomatic activity designed to resolve the crisis.

    U.N. envoy Gamal bin Omar and Abdullatif bin Rashid al-Zayani, secretary-general of a regional alliance that groups Yemen's six Gulf Arab neighbors, were in Yemen on Monday. Saleh and King Abdullah, the Saudi monarch, met in the Saudi capital of Riyadh.

    "The situation is tense. It can't continue like this. This is a sign of deep crisis," bin Omar told The Associated Press.

    U.N. Secretary-General Ban Ki-moon strongly condemned "the excessive use of force by government security forces against unarmed protesters" and called on all sides "to exercise utmost restraint and desist from provocative actions," U.N. spokesman Martin Nesirky said.

    The U.S. Embassy said it regretted the bloodshed and called on all parties to "refrain from actions that provoke further violence."

    "The United States believes that now is the time for an immediate, peaceful and orderly transition," Washington's envoy to the U.N. Human Rights Council, Eileen Chamberlain Donahoe, said in Geneva. Those responsible for abuses against civilians, she said, needed to be brought to justice as part of a reform process.

    Yemen's foreign minister, Abubakr al-Qirbi, said the government was committed to political reforms, but rejected claims of excessive force by police and pro-government militia, accusing some opposition groups of terrorist activity.

    Troops from the Republican Guards and the 1st Armored Division were engaged in skirmishes for most of Monday.

    "I have been hearing heavy explosions and gunshots since morning," said Atiaf Alwazir, a 31-year-old blogger from Sanaa. Soldiers from the 1st Armored Division soldiers, she said, returned fire, giving pro-regime forces "an excuse to shoot at peaceful protesters."

    The 1st Armored Division, along with its commander, mutinied and joined the protesters about six months ago. Its mutiny was followed by a series of high-profile defections that left the president largely isolated but did not weaken his resolve to stay in office.

    Last Thursday, the U.S. State Department raised expectations by predicting Saleh would relinquish power within a week under a Gulf-mediated, U.S.-backed deal that would grant him immunity from prosecution in return for stepping down. But violence flared anew after Saleh said he had asked Vice President Abed Rabbo Mansour Hadi to negotiate further.

    Saleh has already backed away three times from signing the deal, and many believe this move is the latest of many delaying tactics.

    His departure for Saudi Arabia in June left the country without an effective political leadership. Hadi took over the reins of power but his authority appeared to pale in comparison to that of the president's son, two powerful nephews as well as the tribal leaders who took the side of the protesters.
